Delhi – The Supreme Court has dismissed a petition challenging the CRZ clearance given for constructing two additional floors at actor Shah Rukh Khan’s Mumbai residence, ‘Mannat’.

A bench led by Chief Justice Surya Kant, along with Justices Joymalya Bagchi and V Mohana, upheld the National Green Tribunal’s decision. The NGT’s Western Zone Bench in Pune had earlier rejected the plea.

The petition was filed by Mumbai activist Santosh Daundkar, who alleged irregularities in the approvals for the construction.

Court not swayed by celebrity status

Senior Advocate Shoeb Alam, for the petitioner, argued that the case shouldn’t get different treatment just because it involves a film star. He also pointed out that Daundkar was the one who had exposed the Adarsh housing scam.

The bench, however, said fame played no role in its decision. “We are in no way influenced by all of this,” Justice Bagchi observed.

“Law broadly followed”

The CJI said authorities had found substantial compliance with CRZ rules.

“They are living there. If in a residential house they want to have [additional floors]… it’s their choice. Law is broadly followed. Why neighbor or anybody else [should intervene]?” Chief Justice Kant said.

He also expressed doubts about the petitioner’s intent, saying, “I have very serious doubts on the bona fide of the petitioner.”

Alam countered that the NGT itself had not questioned the petitioner’s bona fides.

The court then dismissed the appeal..
