Madras High Court Flags MLA Resignations to Seek Re-Election as ‘Mockery of Democracy’

Chennai: The Madras High Court has sharply criticized the trend of elected legislators resigning shortly after securing office only to contest again from the same constituency under a different political banner, terming the move an insult to voters and a “mockery of democracy.”

A division bench comprising Justices SM Subramaniam and K Govindarajan made the observations while hearing a public interest litigation (PIL). The court emphasized that lawmakers enter public office on the foundation of the electorate’s trust, and abandoning those mandates swiftly to switch sides undermines the democratic framework.

Highlighting the absence of formal regulations addressing the issue, the bench urged the Election Commission of India (ECI) to look into the matter and formulate regulatory guidelines to deter opportunistic resignations under exceptional circumstances.

The petition, filed by Chennai advocate Sudhan, contended that mid-term resignations engineered for partisan advantage impose an avoidable financial strain on taxpayers who fund subsequent by-elections. The plea called for:

• Regulatory accountability mechanisms, including measures tied to election deposits, to recover by-poll expenses from resigning candidates.
• Legislative provisions barring legislators who step down prematurely for political reasons from contesting polls for a defined cooling-off period.
• An interim stay on the upcoming by-elections in the Madurantakam and Dharapuram constituencies, alongside directives restraining the ECI from accepting nominations from the defecting candidates.

The court’s remarks arrive amid political friction in Tamil Nadu following the defection of former AIADMK legislators Maragatham Kumaravel (Madurantakam) and P Sathyabama (Dharapuram) to the ruling TVK, which has fielded both leaders in the by-elections for their vacated seats.

The political developments follow vacancies across seven Assembly constituencies. While Chief Minister Vijay vacated Tiruchi East to retain another winning seat, six seats fell vacant due to AIADMK resignations. By-elections have thus far been scheduled only for Madurantakam and Dharapuram, while polls remain pending in Tiruchi East, Ambasamudram, Perundurai, Karur, and Viralimalai due to pending election petitions. Opposition parties have characterized the defections as an attempt by the minority administration to shore up assembly numbers—an allegation the ruling party refutes.
